Scope: The convention applies to all migrant workers and their families, regardless of their migration status. It defines a migrant worker as a person who is engaged in a remunerated activity in a State of which he or she is not a national. 2. Non-discrimination: The convention prohibits discrimination based on the nationality or immigration status of migrant workers. States are required to ensure equal treatment and protection of rights for migrant workers and their families. 3. Basic Rights: The convention guarantees fundamental human rights to migrant workers, including the right to life, liberty, and security of person; the right to work in just and favorable conditions; the right to freedom of thought, conscience, and religion; and the right to family unity. 4. Labor Rights: The convention emphasizes the protection of migrant workers’ labor rights. It includes provisions on fair and equal treatment in employment, protection against exploitation, freedom of association and collective bargaining, and access to social security and benefits. 5. Protection of Families: The convention recognizes the importance of keeping migrant workers’ families together. It calls for measures to ensure family unity, protect the rights of children of migrant workers, and facilitate family reunification. 6. Social Welfare and Health: The convention emphasizes the right of migrant workers and their families to access social welfare services, healthcare, and education on an equal basis with nationals of the host country. 7. Humanitarian and Consular Protection: The convention obligates states to provide migrant workers with appropriate protection and assistance in cases of emergencies, abuse, or exploitation. It also calls for consular protection and assistance to be extended to migrant workers by their home countries. 8. Recruitment and Placement: The convention addresses the issue of recruitment and placement of migrant workers, emphasizing the need for fair and ethical practices and protection against fraudulent or abusive practices by recruitment agencies. 9. Monitoring and Reporting: States parties to the convention are required to submit periodic reports to the Committee on the Protection of the Rights of All Migrant Workers and Members of Their Families, which monitors the implementation of the convention and provides recommendations. It is important to note that as of my knowledge cutoff in September 2021, the convention has been ratified by 56 countries. However, the level of implementation and adherence to the convention’s provisions varies among countries.
